Das GeschGehG – Schutz von Geschäftsgeheimnissen
An Hochschulen existiert ein enormes Spektrum spezieller Kenntnisse und Erfahrungen, die zwar keine patentfähigen Erfindungen darstellen und dennoch einen beachtenswerten Marktwert haben. Solches Know-how war lange nicht ausreichend gesetzlich vor ungenehmigter Offenbarung und Nutzung durch Dritte geschützt. Mit dem seit April 2019 geltenden Gesetz zum Schutz von Geschäftsgeheimnissen (GeschGehG) liegt nun ein Regelwerk vor, das wertvolle geheime Informationen jeglicher Art unter einen Schutz stellt, der mit Erfindungen vergleichbar ist. Hochschulen und Wissenschaftler*innen können sich auf ein eigenständiges Stammgesetz stützen, das mit seinen Instrumenten wie ein Sonderschutzrecht für geheime Informationen funktioniert. Für Drittmittelanträge ist die Darlegung des Standes der Technik und die Prüfung der Schutzrechtesituation in dem betreffenden Themenfeld essentiell. Zudem müssen die Erfolgsaussichten des Projektes und das Marktpotenzial der Technologie analysiert werden.
